Timmons Properties Text Messaging Service (SMS/MMS) Policy

In addition to the Terms of Use, notices, and policies posted on the Timmons Properties (“Timmons,” “we,” “us,” or “our”) website—which govern your use of our services—the use of any Timmons Properties text messaging programs, including SMS and MMS (the “Text Messaging Service”), is subject to this Text Messaging Service (SMS/MMS) Policy (“Policy”).

“Text Messaging” includes SMS (“Short Message Service”), MMS (“Multimedia Message Service”), and may include future messaging technologies such as Rich Communication Services (“RCS”) or certain over-the-top (OTT) messaging platforms (collectively, “Text Messages”).

This Policy applies whether you are a homeowner, resident, board member, vendor, or other individual interacting with our Community Association Management services or our general business operations.

Important Notice: You are encouraged to consult qualified legal counsel to ensure any proposed use of the Text Messaging Service complies with all applicable laws. This Policy provides guidelines but does not constitute legal advice. Timmons makes no representation that meeting the requirements of this Policy ensures compliance with all international, federal, state, or local laws, regulations, or industry codes (“Applicable Laws”). By choosing to receive or use our Text Messaging Service, you agree to this Policy.


1. Service Description and Limitations

The Text Messaging Service is provided on an “as is” and “as available” basis. Timmons relies on third-party messaging service providers, carriers, and network operators to deliver Text Messages, including but not limited to:

  • Community updates
  • Association notices
  • Account or payment alerts
  • Emergency or urgent communications
  • Appointment notifications
  • General communications related to Community Association Management services

Service Limitations:

The Text Messaging Service may not be available on all devices or through all carriers, and functionality may vary based on carrier capabilities. Delivery is not guaranteed. Timmons is not responsible or liable for:

  • Delayed or undelivered messages
  • Carrier outages
  • Device incompatibility
  • Message filtering by carriers or mobile operating systems

You acknowledge that receipt of Text Messages may depend on your mobile carrier and plan.


2. Consent to Receive Messages

By providing your mobile number to Timmons Properties, you expressly consent to receive Text Messages related to:

  • Your homeowner or resident account
  • Your community association
  • Property management operations
  • Requests, support tickets, or maintenance matters
  • Compliance notices
  • Meeting reminders
  • Other communications reasonably related to services we provide

Opt-Out Instructions: You may opt out at any time by replying STOP to any text message from Timmons Properties. Upon receipt of your STOP request, we will send you a confirmation message and discontinue sending text messages to your number unless you opt back in.

  • Reply HELP for assistance
  • Contact us using the information provided in Section 7 below

Message Frequency: Message frequency varies depending on your account activity, community events, and service needs. You may receive multiple messages per week during active periods.

Cost: Message and data rates may apply based on your mobile carrier’s plan. Please contact your carrier for details about your text messaging plan.


3. No Unauthorized Use or Resale

You may not use, forward, distribute, or resale access to the Text Messaging Service for any commercial purpose or on behalf of third parties unless expressly permitted under a separate written agreement with Timmons.

The Text Messaging Service is intended solely for your personal use in connection with your relationship with Timmons Properties and your community association.


4. Right to Suspend or Terminate the Service

Timmons reserves the right to modify, suspend, or discontinue the Text Messaging Service at any time and for any reason, including but not limited to:

  • Compliance with legal requirements
  • Security concerns
  • Operational needs
  • Changes in carrier requirements or capabilities
  • Technical or system maintenance

Where required by Applicable Laws, we will provide advance notice of any material changes to the Text Messaging Service. We are not liable for any losses or damages resulting from suspension or termination of the service.


5. User Responsibilities

By using the Text Messaging Service, you agree that:

  1. Authorization: The mobile number you provide belongs to you, or you have full authorization from the account holder to provide it and receive text messages at that number.
  2. Lawful Use: You will not use the Text Messaging Service for unlawful, abusive, harassing, fraudulent, or otherwise inappropriate purposes.
  3. Accurate Information: You will ensure your contact information remains accurate and up to date. You are responsible for notifying us of any changes to your mobile number.
  4. Legal Compliance: You will comply with all Applicable Laws related to your use of text messaging, including when you initiate requests, respond with personal information, or send messages to our team.
  5. Device Security: You are responsible for maintaining the security of your mobile device and ensuring that unauthorized individuals do not have access to text messages sent to you by Timmons Properties.
  6. Prompt Notification: You will promptly notify us if you believe there has been unauthorized use of your mobile number or if you no longer have access to the number you provided.

6. Privacy and Data Protection

Timmons Properties respects your privacy and handles your personal information, including your mobile phone number, in accordance with our Privacy Policy.

Data Collection: When you opt in to receive text messages, we collect and store your mobile phone number along with other information you provide (such as your name, address, and association details).

Data Use: We use your mobile number solely to:

  • Send you text messages related to our services
  • Respond to your inquiries and requests
  • Fulfill our obligations under our management agreement
  • Comply with legal requirements

Data Sharing: We do not sell, rent, or share your mobile phone number with third parties for their marketing purposes. We may share your information with:

  • Our third-party messaging service providers who assist in delivering text messages
  • Service providers who help us operate our business (under strict confidentiality agreements)
